In short, filing an uncontested divorce is the cheapest way to get a divorce. This means that your spouse has agreed on a divorce, and has also agreed on all ancillary matters such as the divison of assets and maintenance. In such cases, lawyers typically offer fixed fee arrangements so that your legal costs are kept under control.
Parties may file a divorce application on a simplified track if they can agree (i) that the marriage has irretrievably broken down, and (ii) on the ancillary matters such as children’s care arrangements (if applicable), maintenance and the division of matrimonial assets. A divorce application on a simplified track may take about 4 months to conclude.
A divorce on the normal track typically takes approximately 3 to 4 months for the Interim Judgment of Divorce to be granted, depending on the nature of the dispute and complexity, and another 3 to 8 months after that for all ancillary matters (i.e. children issues, maintenance, and the division of matrimonial assets).
The documents that are filed in court will differ, depending if you are the Plaintiff or the Defendant. Who files first for divorce does not affect the outcome in the ancillaries matters.
